General Terms and Conditions

of Haromex Development GmbH

Minimum Order Quantity | There is no minimum order quantity. We supply orders starting from a single bottle. (Shipping costs apply to small or very small quantities.)

Scope of Application | The following General Terms and Conditions (GTC), in the version valid at the time of the order, apply exclusively to business relationships between Haromex Development GmbH and the client. Haromex Development GmbH does not recognize any deviating terms and conditions of the client unless expressly confirmed by us in writing.

Conclusion of Contract | Offers made by Haromex Development GmbH are subject to change and are non-binding. Upon submission of the order and the associated confirmation of receipt, we accept your order, and a legally binding contract is concluded. We reserve the right to withdraw from the contract in the event of clerical, printing, or calculation errors. As a rule, we deliver within 3–5 working days.

Prices | Our prices are quoted in euros, plus the applicable statutory VAT.

Delivery Terms | For delivery addresses within Germany, we provide free delivery for orders with a net invoice value of €500.00 or more; for orders below this value, a freight surcharge of €15.00 per shipping unit applies. Deliveries abroad are available upon request only.

Partial Deliveries | We are entitled to make partial deliveries, provided this is reasonable for the customer. Changes to the design and appearance of the bottles are possible and do not affect the validity of the contract.

Liability for transport damage / Transport insurance | Shipments are insured against breakage and damage. If a parcel arrives damaged when shipped via parcel service, please refuse delivery. For pallet shipments, any damage or shortages will only be reimbursed if confirmation from the freight forwarder (driver's signature) is provided. Please check the number of bottles and the varieties immediately upon receipt of the shipment. Obvious defects (breakage, shortages, and incorrect deliveries) must be reported immediately to the parcel service or freight forwarder and to Haromex Development GmbH within 24 hours. Upon receipt of the damage report, Haromex Development GmbH will arrange for a replacement shipment or issue a credit note.

Payment methods

Invoice | We supply business customers on an invoice basis, payable net within 14 days. Any cash discount amounts deducted without authorization will be reclaimed. Additional costs resulting from non-compliance with payment terms or late payment will be charged to the client, plus applicable interest and fees. We supply private customers only in exceptional cases and exclusively against prepayment.

Direct Debit | Alternatively, we offer payment via direct debit with a 2% cash discount. We will send you the relevant documentation upon request.

Cash on Delivery | Not offered.

Warranty | During the warranty period, if a defect exists in the delivered goods, the initial right is to rectification or replacement delivery, with Haromex Development GmbH having the right to choose between these options. If defect-free goods are not delivered within a reasonable period, the client is entitled, at their discretion, to demand rescission (cancellation of the purchase) or a price reduction. Statutory provisions apply to any warranty claims.

As many spirits are natural products, natural variations are unavoidable. Such variations (e.g., sediment, protein flakes, tartrate crystals, or deviations/changes in color) do not affect the quality of the product. Liability for such variations is excluded. Haromex Development GmbH reserves the right to decide on replacements at its own discretion; the customer has no legal entitlement to a replacement.

Liability | Haromex Development GmbH is liable only for gross negligence and willful misconduct. This also applies to liability for employees, agents, and representatives. We are liable for damages caused by the breach of essential contractual obligations (cardinal obligations) and the absence of guaranteed characteristics, insofar as such liability is not excluded by the General Terms and Conditions.

Right of Withdrawal and Return | The customer may withdraw from the contract without giving a reason within one week of receiving the goods. Timely dispatch of the notice of withdrawal is sufficient to meet the deadline. If the customer exercises their right of withdrawal, they are obliged to return the goods in packaging suitable for shipment at the expense and risk of Haromex Development GmbH. Reimbursement is provided only for goods that arrive at the sender's location in undamaged condition.

Place of Performance, Place of Jurisdiction | For merchants, the place of performance for deliveries and payments, as well as the place of jurisdiction, is Krefeld. Haromex Development GmbH is also entitled to bring legal action at the customer's place of jurisdiction. The contractual relationship between the parties is governed by the laws of the Federal Republic of Germany.

Only persons over the age of 18 are eligible to purchase spirits and wines from our company. This is expressly confirmed upon submission of the order.
